Terms of Service and License Agreement

These terms govern your use of the AitJaz application (the “App”) provided by sole proprietor “Lotus Group”, Republic of Kazakhstan (the “Licensor”, “we”). By installing the App or paying for a license you accept these terms.

1. License

1.1. We grant you a personal, non-exclusive, non-transferable license to use the App (voice typing software for Windows) for its intended purpose.

1.2. All intellectual property rights in the App, its name and logo remain with the Licensor. The App includes third-party open-source components distributed under their own licenses (listed with the App).

2. Free trial

After installation the App works for free with all features for 7 days. No registration or card is required. After the trial a license key is needed to continue.

3. Paid license and price

3.1. The license is perpetual, paid once, and allows use on 2 (two) computers of one user. Transfers to a new computer are available on request.

3.2. The price is shown on aitjaz.com and depends on your country (USD 20 outside Kazakhstan and Russia). Taxes may be added at checkout where required.

3.3. Updates within the current major version are free.

4. Payment and delivery

4.1. International payments are processed by our online payment provider, which may act as the reseller / merchant of record for your order. Its terms also apply to the payment.

4.2. The license key is delivered to your email after payment is confirmed. Enter it in the App: tray icon → “Activation”. Delivery of the key completes our obligation to deliver.

5. Refunds

You may request a full refund within 14 days of purchase, no questions asked, by messaging us on WhatsApp (+7 705 791 0303) or emailing info@aitjaz.com. After a refund the license key is revoked and you must stop using the App. See our Refund Policy.

6. Restrictions

You may not share or publish your license key, sell, rent or sublicense the App, circumvent license checks, reverse-engineer or modify the App (except where expressly permitted by law), or use it to violate any law or the rights of others. We may revoke a key used in breach of these terms without refund.

7. Disclaimer and liability

7.1. The App is provided “as is”. Speech recognition is never error-free: always review text before sending, especially in legal, medical or other important documents.

7.2. You can evaluate the App on your own computer during the free trial and with the built-in compatibility check before buying.

7.3. To the maximum extent permitted by law, our total liability is limited to the amount you paid for the license. We are not liable for indirect or consequential damages or lost profits. Nothing in these terms limits rights you have under mandatory consumer protection laws of your country.

8. Privacy

8.1. How we process data is described in our Privacy Policy.

8.2. By default, speech recognition runs on your computer. Voice recordings, files and recognized text are not sent to the Licensor or to any third party, except in the cases listed in section 8.3.

8.3. Voice recordings, files and recognized text are sent only in the following cases, each of which happens only as a result of your own action:

• (a) you turn on cloud recognition in the App settings yourself and enter your own API key of a speech recognition service you choose. In this case the audio of your phrases (and, if selected, recordings in “Audio & video to text”), together with the speech language and the words of your vocabulary, is sent from your computer directly to that service. The Licensor receives neither the audio, nor the text, nor your key; this data is processed by the service you chose, under its own rules and your agreement with it;
• (b) you send a message using “Report a problem”. The Licensor receives your text, your e-mail (if given), the App and Windows versions, the selected languages and a random installation number. If the box “I allow sending the audio and text of my recent phrases about this problem” is checked (it is checked by default and you can uncheck it), the recordings and recognized text of your phrases from the last 30 minutes, at most 10, are also sent;
• (c) you start the recognition test yourself and check the consent box (it is unchecked by default). The Licensor receives the recordings of the test phrases you read, the recognized text, recognition times, the selected languages, the App and Windows versions, the microphone name and a random installation number.

8.4. Other internet requests made by the App (downloading speech recognition and speaker separation models, checking for and downloading updates, validating a key bought through the payment provider, checking the status of a problem report you sent, asking whether a recognition test is needed) do not contain your voice or text. What they contain is described in the Privacy Policy.

8.5. Text already written in the window before the cursor is not sent in any of these cases.

9. Governing law

These terms are governed by the laws of the Republic of Kazakhstan, without prejudice to mandatory consumer protection rules of your country of residence. Disputes are first resolved by negotiation.

10. Changes

We may update these terms by publishing a new version on this page. The terms in force on the date of your payment apply to your license.
